Marketing Footage Release

This release is a separate, optional permission. It is not part of the Customer Terms of Service, and accepting those Terms does not give it. You may place your order without it and pay the full price.

1. What this release is

Company owns the copyright in Mission deliverables (Customer Terms of Service, section 9.1). Under section 9.5 of those Terms, Company does not use Mission imagery publicly unless you give separate, affirmative written permission for a specific Mission. This release is that permission. It covers only the one Mission for which you accept it. Company records your acceptance with that Mission, as described in section 19 of the Terms.

2. When this release takes effect

This release is given in exchange for a promotional price. It takes effect only when your payment for the Mission at the promotional price succeeds. It never takes effect, or it ends, without any action by you if:

  • the promotional price is not applied to your order;
  • your reserved promotional price expires before you pay;
  • the Mission is cancelled before any imagery is captured; or
  • the full amount you paid for the Mission is refunded.

3. What Company may do

While this release is in effect, Company may use, copy, edit, display, publish and distribute photographs and video from the Mission to market Send a Drone and its services. This includes Company's website, social media accounts, online and printed advertising, proposals, pitch decks, presentations, and portfolio and sales material, anywhere in the world. Company may crop, resize, color-correct, blur, combine and caption the imagery and add Company's own text, logo and graphics. Company's service providers (for example advertising platforms, designers and printers) may handle the imagery only to do this for Company.

You receive no royalty, fee or other payment for this use beyond the promotional price.

Company will not sell or license the imagery to others as stock or generic drone content, and will not include it in a dataset used to train machine-learning models.

4. What Company will not do

Company will not:

  • use imagery of residential property, or imagery that is subject to an open imagery privacy request (Customer Terms of Service, section 9.5);
  • state your name, your company's name, the property's address, or the name of its owner or occupants, or present the imagery as your endorsement or testimonial, unless you agree to that separately in writing;
  • use imagery in which a person, a legible license plate, or another business's sign or trademark is the main subject, unless it is blurred or cropped so that it is not;
  • identify the Pilot who flew the Mission; or
  • use imagery that Company has blurred, restricted or deleted under an imagery privacy request, except in the form that process allows.

Company reviews each image or video before its first marketing use.

5. Your statements

By accepting this release you state that you are the owner or lawful occupant of the property, or that you act for the owner or occupant named in the Mission Authorization with authority to give this permission for them, and that you can show that authority on request. This is in addition to your statements in section 4.2 of the Customer Terms of Service.

6. When Company stops without your withdrawal

Company stops new marketing use of the Mission's imagery, and removes it from the places it controls, if an imagery privacy request is made for it (until that request is decided, and permanently if the decision restricts or deletes the files), if the payment for the Mission is disputed or charged back, or when the imagery's retention period under the Privacy Policy ends.

7. Withdrawing this permission

You may withdraw this permission at any time from your Mission page, or by emailing support@sendadrone.us with the subject line "Marketing permission". Withdrawal is effective when Company receives it, for all future use. After receiving it, Company makes no new use of the imagery and, within 10 business days, removes it from Company's website, from social media accounts and advertising that Company controls, and from material Company still distributes. Company does not have to recall printed material already distributed, or remove copies that others have shared or stored.

Your withdrawal is effective whether or not you repay the discount under section 8.

8. Repaying the promotional discount if you withdraw

You received a lower price in exchange for this permission. If you withdraw it before the Mission's deliverables are first delivered to you, or within 12 months after that delivery, you agree to repay the amount of the promotional discount shown on your order. For example, if a $199.00 Mission was discounted by $39.80, you repay $39.80. The repayment returns the price reduction you received for this permission. It is not a fee or a penalty.

  • How you repay. Company sends you a secure payment link, and your Mission page shows the amount. Company does not keep a payment method on file and never charges you automatically (Customer Terms of Service, section 6).
  • If you do not repay. Your withdrawal still stands and your license to the Mission's files under section 9.1 of the Terms is not affected. While the repayment is unpaid, you are not eligible for later Send a Drone promotions, and Company may contact you about the amount.
  • When nothing is owed. You owe nothing if you withdraw more than 12 months after delivery, if the release never took effect or ended under section 2, if Company stopped using the imagery for a reason in section 6 rather than because you withdrew, or if Company waives the repayment.

9. Pilots

This release gives the Pilot no right to use or publish the imagery. The Pilot has no portfolio or publication right (Customer Terms of Service, section 9.6).

10. How this release fits with your other documents

This release is a written permission under section 9.5 of the Customer Terms of Service. On the use of Mission imagery for Company's marketing, it controls for its Mission. Otherwise the Terms, the Cancellation, Refund & Recapture Policy and the Privacy Policy apply as written. Texas law governs this release, as set out in section 18 of the Terms.
