Send a Drone

Customer Terms of Service

Version 1.4 · Effective October 22, 2026 · Send a Drone, LLC

These Customer Terms of Service ("Terms") govern your use of the Send a Drone platform and every order for aerial imagery, video and visual documentation (a "Mission"). "Company," "we" and "us" mean Send a Drone, LLC, a Texas limited liability company. "Pilot" means the independent remote pilot assigned to a Mission. By creating an account, placing or paying for a Mission, or accepting these Terms electronically, you agree to them.

The platform is offered for business purposes, such as property sales and listings, property management, construction, permitting, signage and site documentation. Before checkout, every customer, including a guest, must make this representation in the Mission Authorization for each Mission: "I am ordering for a business or commercial documentation purpose, not for personal, family, or household use." If an order is nevertheless for personal, family or household use, these Terms still apply to it, the same refunds apply, and nothing in these Terms waives any right that cannot be waived under Texas or federal consumer-protection law.

1. The platform; Company is not the pilot

Company operates an online platform that connects customers with independent, FAA-certificated remote pilots. Pilots are independent contractors, not Company employees or agents. The assigned Pilot is the remote pilot in command and is solely responsible for flight operations, airspace compliance and flight safety. Company coordinates ordering, consent, pricing, payment, dispatch, quality review and delivery. Company does not guarantee a particular Pilot, date, time, time window or flight path.

Company requires every assigned Pilot to be qualified under Company's pilot standards, to hold the FAA certification and insurance those standards require, to operate lawfully and safely, and to deliver within the Mission's scope and the service's deliverable specification. Company does not share Pilots' agreements, credential or insurance documents, payouts, or internal qualification and performance records with customers.

2. Coverage, ordering and assignment

2.1 Covered addresses. When you enter a property address, the platform checks whether at least one eligible Pilot currently serves that address. If one does, you see the price for the selected service and pay at checkout. The Mission is offered to Pilots only after your payment is verified and every consent and review the Mission Authorization requires is complete.

2.2 Addresses outside current coverage. If no eligible Pilot currently serves the address, you may still submit a request. No payment is collected and no Pilot is dispatched. A request outside coverage is a non-binding expression of interest. It does not reserve a Pilot or a date and does not guarantee that service will become available. If eligible coverage later appears, we may notify you; the notice links to the then-current price, which may differ from any earlier estimate. You may ask us to find a Pilot at no charge. If a Pilot accepts, the Mission is held for that Pilot for a limited time (currently two hours), during which you may pay. A Mission is formed only when you complete checkout. If no Pilot accepts within 24 hours, or a hold ends without payment, nothing is charged and your request returns to waiting for coverage. We never charge you automatically for a request outside coverage.

2.3 Assignment. After payment and completed consent, the Mission is offered to eligible Pilots and is assigned when a Pilot accepts it (or, for a held request, to the Pilot who held it). Coverage means a Pilot can serve the address; it does not guarantee assignment by a particular date. Once a Pilot is assigned, your Mission page shows the Pilot's first name and last initial. Company does not give customers a Pilot's contact details, and communication about the Mission goes through the platform.

2.4 If a Pilot withdraws. If the assigned Pilot withdraws or does not appear, Company returns the Mission to dispatch and tries to assign another Pilot or reschedule. A Pilot's withdrawal does not by itself cancel your Mission or trigger a refund. If Company ultimately cannot provide the purchased service, it cancels the Mission and refunds the amount paid as described in the Cancellation, Refund & Recapture Policy.

3. Mission information

You must provide accurate property, occupancy, parcel, scheduling, site-contact, access and safety information, the names and email addresses of every person whose consent the Mission Authorization requires, and any specific capture instructions. Company and the Pilot may rely on it. The price and scope of a paid Mission are fixed at checkout. A change of service or scope (for example, additional buildings or parcels) requires a new Mission.

4. Property authority, consent and Texas Government Code Chapter 423

4.1 Basis for every Mission. Company flies a Mission only on the consent of the owner or lawful occupant of the property to be documented, recorded in a Mission Authorization for that Mission. Company does not rely on any other exception in Texas Government Code §423.002 unless it confirms so in writing for a specific Mission.

4.2 Your representations. For each Mission you represent that (a) you are the owner or lawful occupant of the property, or you act for the owner or occupant named in the Mission Authorization under authority you can show on request; (b) every person you name as consenting is the person you say, at an email address that belongs to that person; (c) the information you give about the property, its occupants, its parcels, its boundary and any restrictions is accurate; and (d) your purpose is lawful documentation of the identified property.

4.3 Consent requests. Where the Mission Authorization requires consent from someone other than you, Company emails that person a consent request. A consent is valid only when that person opens the request, types their full name and confirms consent; a person acting for an entity also confirms that they are authorized to act for it. Company may reject or review a consent that comes from your own email address, from your organization's email domain, from the device or internet connection used to place the order, or from a name that does not match the public owner record. Listing Aerials may be ordered only by a licensed real estate broker or sales agent, or by a property manager, and the seller's consent may instead be shown by uploading the signed listing agreement page that names the seller and authorizes marketing of the property.

4.4 Scope of capture. Pilots deliberately capture only the identified property within the Mission boundary. You will not request imagery of dwelling interiors, of people as subjects, of people in places where they have a reasonable expectation of privacy, or of neighboring property except with that owner's or occupant's consent recorded in a Mission Authorization.

4.5 Incidental capture. Wide and approach shots may show neighboring property, public rights-of-way, vehicles and people. Pilots frame shots to keep these incidental. Company may crop, blur or withhold frames in which a neighbor or a person is the main subject, and blurs faces and license plates in Listing Aerials. You will not use incidental content to identify, track or publicize any person or neighboring property.

4.6 Withdrawal of consent and privacy requests. You may withdraw your consent before a flight from your Mission page. Any other person who consented may withdraw from their consent page or by emailing support@sendadrone.us with the subject line "Privacy". Owners, tenants and people shown in Mission imagery may make an imagery privacy request under the Privacy Policy. A request made through Company's imagery privacy form automatically withdraws imagery from Missions at that address from your gallery while Company reviews it; if the files are released, your 90-day access period is extended by the time they were withdrawn. If Company blurs, restricts or deletes imagery under that process, you will do the same with your copies within 10 business days after Company asks, and your license in section 9.1 no longer covers the affected files.

4.7 No representation of lawfulness. Accepting an order is not legal advice and is not a representation that any capture, use or disclosure is lawful under Chapter 423 or any other law. A Pilot may decline or limit any part of a Mission the Pilot reasonably believes cannot be captured safely or lawfully.

5. Scheduling and Pilot safety authority

Requested dates and time windows are targets, not guarantees. Missions may be delayed or rescheduled because of consent timing, weather, airspace restrictions (including temporary flight restrictions), safety, equipment, site access, people or traffic, emergencies, Pilot availability or other conditions outside reasonable control.

You may describe the results you want, but you may not direct a Pilot to violate the law, an FAA authorization, manufacturer limitations or the Pilot's reasonable safety judgment. The Pilot may refuse to launch, or may stop a flight, for legitimate safety or legal reasons. That decision is not a breach by Company or the Pilot.

6. Price and payment

The price shown at checkout is the full price for the Mission scope shown. There are no mileage, travel or expedite surcharges. Payment is taken at checkout through our payment processor, Stripe, with Company as merchant of record, including for Missions that still await consent. Company does not receive or store your full card number and does not keep a payment method on file. Where the Cancellation, Refund & Recapture Policy allows Company to keep part of a payment, that amount is kept from the payment you already made and any remainder is refunded to your original payment method. Company will not charge you additional amounts for a Mission without your action. A Construction Progress 4-Pack is paid in full at checkout; its four visits are scheduled and flown separately.

Promotions. Company may offer a promotion code. A promotion applies only as its own terms, shown and accepted at checkout, allow, and the price shown at checkout already includes any discount. A promotion's terms control for that promotion only.

If you dispute or charge back a payment after conforming deliverables were delivered, your license to that Mission's files is suspended until the dispute is resolved in Company's favor or withdrawn, and Company may suspend your account under section 17. This does not limit your right to dispute a charge you did not authorize.

7. Cancellation, rescheduling and recapture

The Cancellation, Refund & Recapture Policy is part of these Terms. It sets the amounts, if any, kept when a Mission is cancelled; what happens when consent is not given in time; how weather, airspace, safety and access problems are handled; and when a no-charge recapture is available.

8. Deliverables

8.1 Observational imagery only. Deliverables are observational photographs and video of conditions visible at the time of capture. They are not an engineering report, land survey, ALTA survey, code inspection, roof certification, structural evaluation, appraisal, environmental assessment, electrical opinion, insurance inspection or other licensed professional opinion or certification. Company does not provide written conclusions about a property's condition. You will not represent deliverables as any of the foregoing.

8.2 What you receive. Each service includes the deliverables described at ordering under Company's Deliverables Standard:

  • Building / Sign Survey: 12 edited still photographs; no video.
  • Property Management Exterior: 12 edited still photographs, plus 6 more for each additional building purchased; no video.
  • Listing Aerials: 10 edited still photographs and one silent video of 20 to 30 seconds, with faces and license plates blurred.
  • Roof / Exterior Documentation: 16 edited still photographs; no video.
  • Construction Progress: for each visit, 12 edited still photographs and one silent video of 20 to 30 seconds.
  • CRE Site Package: 20 edited still photographs, including a front elevation of each principal building purchased, and one silent video of 45 to 60 seconds.

Still photographs are edited JPEG files (exposure, white balance, cropping, straightening and lens correction only, plus privacy blurring where these Terms require it). Video is delivered as MP4. RAW files and written narratives are not included. Documentation imagery is not altered to misrepresent site conditions. Items outside the Mission boundary are removed from the required list.

8.3 Items that cannot be captured. Some items do not exist at a property, or cannot be captured safely or lawfully on the day of the Mission. The Pilot records such an item as "unable to capture" with a reason. Company reviews those notes, and unable-to-capture items that Company accepts are shown with your deliverables.

8.4 Review and delivery. Deliverables are delivered after they pass Company's quality review, through a private web gallery on your Mission page with a downloadable ZIP file. Typical delivery is within 2 business days after a completed flight. This is an estimate, not a guarantee. It starts after the flight is completed; time lost to consent, weather, safety or site-access problems, any recapture, and any wait for payment or coverage is outside it. A delivery later than the estimate does not change the price.

8.5 Guest orders. If you order without an account, you reach your Mission page through a private link for that Mission only. Each link works for 7 days. You may request a new link from the Mission page; it is emailed only to the address given for the Mission, it replaces the previous link, and requests are limited. Keep your link private: anyone who has it can see that Mission's status and files until it expires or is replaced.

8.6 Problems with deliverables. You may report a problem with delivered files from your Mission page. Company reviews each report and decides whether a no-charge recapture applies under the Cancellation, Refund & Recapture Policy.

8.7 Availability of files. Your gallery and ZIP download are available for 90 days after delivery; a new link does not extend that period. Please download and keep your own copies. Company keeps Mission photographs and video for 12 months after the Mission is closed and then deletes them; it does not archive them instead. An open dispute, chargeback, recapture, privacy request, incident or claim places a hold that pauses deletion for that Mission until the matter closes. The Privacy Policy states every retention period.

9. Rights in Mission imagery

9.1 Your license. Company owns the copyright in Mission deliverables. When you have paid for a Mission in full, Company grants you a perpetual, irrevocable (except as stated in sections 4.6 and 6), non-exclusive, worldwide, royalty-free license to use, copy, display, distribute, publish and make ordinary edits of the delivered files for business purposes related to the Mission property. These include marketing the property for sale or lease, permits, insurance, financing, construction and property records, and reporting to landlords, tenants, lenders and other property stakeholders.

9.2 Sharing for the property. You may sublicense the delivered files, without further permission, to multiple listing services, real estate listing portals, brokers, lenders, insurers, appraisers, contractors, sign and design vendors, landlords, tenants, associations and government authorities, solely for purposes related to the Mission property. Those recipients' ordinary syndication of a property listing is within this license.

9.3 What the license does not allow. You may not sell or license the delivered files as stock or generic drone content, contribute them to a stock-content library, include them in a dataset used to train machine-learning models, or use them for any purpose unrelated to the Mission property.

9.4 Company's operational use. Company may keep and process Mission imagery as reasonably necessary for fulfillment, quality review, recapture, privacy requests, disputes, insurance, tax and recordkeeping, and security. These operational uses do not include public marketing.

9.5 Public marketing only with your permission. Company does not use Mission imagery publicly, for example on its website, in advertising, on social media, in pitch decks or in portfolio or sales material, unless you give separate, affirmative written permission for a specific Mission. Accepting these Terms does not give it, and you may withdraw it at any time for future use. If you gave that permission in exchange for a promotional price, the terms you accepted with it may require you to repay the discount when you withdraw it; your withdrawal is effective whether or not you do. Company never uses residential imagery, or imagery subject to an open privacy request, for marketing.

9.6 Pilots. The assigned Pilot may use Mission imagery only to fly, fulfill and deliver the Mission and has no portfolio or publication right.

9.7 Tools and know-how. Company and Pilots keep their rights in pre-existing tools, software, templates, processes and know-how.

10. Customer materials

You keep your rights in materials you provide, such as instructions, listing agreements and reference files. You grant Company and assigned Pilots a limited license to use them solely to perform and administer your Missions, and you represent that you may grant that license.

11. Privacy

The Privacy Policy describes how Company collects, uses, shares, retains and protects personal information and Mission data, and how anyone may make an imagery privacy request. Before a Pilot is assigned, Pilots see only a general area for your Mission. The exact address, Mission boundary and your site contact are shared with the assigned Pilot once the Pilot is assigned to your paid Mission.

12. Acceptable use and restricted locations

You will not use the platform for unlawful surveillance, stalking, harassment or intimidation; to identify or track a person rather than document the authorized property; to interfere with emergency response, law enforcement, aviation or critical infrastructure; to request trespass or airspace violations; to carry a payload; or to misrepresent imagery as a licensed professional certification.

You will tell Company at ordering if the property is, adjoins or contains a critical infrastructure facility as defined in Texas Government Code §423.0045 (for example a substation, telecommunications structure, freight terminal, water facility or fenced oil and gas site), a sports venue under §423.0046, a school, an airport, or a correctional, military or other government facility. Company reviews every address for these locations before dispatch. That review concerns consent and restricted locations; Company does not review airspace or determine whether a location can lawfully be flown. For a listed facility within the Mission boundary, Company requires the prior written consent of its owner or operator. Company may limit the Mission boundary or decline the Mission, with a full refund. The Pilot, as remote pilot in command, is responsible for airspace compliance and for every FAA authorization a flight requires.

13. Your responsibilities on the day

You will provide a site contact who can confirm access and consent, disclose known hazards and restrictions, and make the property reasonably accessible during the scheduled window. Access failures caused by the customer (for example a locked gate, a wrong address or missing permission) are handled under the Cancellation, Refund & Recapture Policy.

14. Disclaimers

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, SERVICES ARE PROVIDED "AS AVAILABLE." COMPANY DOES NOT GUARANTEE THAT COVERAGE, PILOT AVAILABILITY, CONSENT, WEATHER, AIRSPACE OR SITE CONDITIONS WILL PERMIT A FLIGHT AT A PARTICULAR TIME. COMPANY DOES NOT WARRANT THAT IMAGERY WILL REVEAL EVERY DEFECT, CONDITION, DIMENSION OR FACT ABOUT A PROPERTY.

15. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY'S AGGREGATE LIABILITY ARISING FROM A MISSION WILL NOT EXCEED THE AMOUNT PAID TO COMPANY FOR THAT MISSION, AND COMPANY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR LOST-PROFIT DAMAGES. THESE LIMITS DO NOT APPLY TO GROSS NEGLIGENCE, WILLFUL MISCONDUCT, FRAUD, BODILY INJURY CAUSED BY COMPANY, OR A PARTY'S INDEMNITY OBLIGATIONS, OR WHERE TEXAS LAW FORBIDS THE LIMITATION.

16. Indemnification

YOU WILL DEFEND, INDEMNIFY AND HOLD HARMLESS COMPANY, ITS AFFILIATES, MEMBERS AND MANAGERS, AND THE ASSIGNED PILOT FROM THIRD-PARTY CLAIMS, PENALTIES AND REASONABLE ATTORNEY'S FEES ARISING FROM (A) ANY INACCURATE STATEMENT IN A MISSION AUTHORIZATION, INCLUDING A STATEMENT THAT AN OWNER, OCCUPANT OR PRINCIPAL CONSENTED OR THAT AN EMAIL ADDRESS BELONGS TO THEM; (B) YOUR LACK OF REQUIRED PROPERTY OR USE AUTHORITY; (C) YOUR UNLAWFUL INSTRUCTIONS; (D) CUSTOMER-SUPPLIED MATERIALS; OR (E) YOUR USE, DISCLOSURE OR DISTRIBUTION OF DELIVERABLES, INCLUDING AFTER COMPANY HAS ASKED YOU TO BLUR OR DELETE THEM. THIS SECTION DOES NOT APPLY TO THE EXTENT A CLAIM ARISES FROM COMPANY'S OR THE PILOT'S OWN NEGLIGENCE, WILLFUL MISCONDUCT OR VIOLATION OF LAW.

Company will notify you promptly of a claim and cooperate reasonably. You may not settle a claim in a way that admits fault for, or imposes obligations on, Company or a Pilot without their written consent. Assigned Pilots are intended third-party beneficiaries of this section.

17. Suspension

Company may refuse, suspend or cancel Missions or accounts involving fraud, payment abuse, chargebacks after conforming delivery, false or self-made consents, false Mission Authorizations, unlawful requests, threats, repeated misuse, substantiated privacy complaints, safety risk or material breach. A cancellation by Company under this section follows the Cancellation, Refund & Recapture Policy.

18. Governing law, venue and jury waiver

Texas law governs, without regard to conflict-of-laws rules. Court actions must be brought in a state or federal court in Texas and, where the law allows the parties to choose venue, in Denton County, Texas, where Company's principal office is located. Either party may bring an eligible claim in small claims (justice) court. No arbitration agreement applies.

EACH PARTY KNOWINGLY AND VOLUNTARILY WAIVES ANY RIGHT TO A JURY TRIAL IN ANY ACTION ARISING FROM THESE TERMS OR A MISSION, TO THE EXTENT THE LAW ALLOWS.

19. Electronic records; changes; acceptance

You agree to transact electronically and consent to electronic records, notices and acceptance. Company records each acceptance and consent with the document version, a checksum of the accepted text, the time, the IP address and browser, and your account or guest record; a guest record is linked to your account if you later create one. When Company publishes a new version of these Terms, the Privacy Policy or the Mission Authorization, you will be asked to accept it before your next paid order. Missions already paid for remain governed by the versions you accepted for them. Company may assign these Terms to an affiliate or successor. If any provision is unenforceable, the remainder stays in effect.
